Kenya’s Media Bill has passed into law this year. The bill remained unsigned in 2009 while media owners and other related sectors lodged appeals with the President and apparently there was an agreement to have certain contentious parts removed before ascension.  However the Bill now enacted with a number of the controversial sections remaining has once again caused uproar. The Act tightly regulates and censors media content. For example ‘sex’ talk on  radio can now only be aired after 10pm, and local content programs must constitute at least 40% of all viewing. In addition, cross-media ownership has been banned. Whilst frequency allocations must be renewed every seven years. The bill also prevents the media from airing or printing anything that may be construed as incitement in the wake of the post election violence. ‘..accurate and unbiased..’ reporting and distinguishing ‘..opinion from fact..’ are terms used in the Act.The new law touches on other sectors too. It bars trade unions from operating radio stations, thus ruffling the feathers of the trade unions. And it is apparently illegal to install certain ring tones on mobile phones or to customise facial appearances with potentially offensive features. With the aim of curtailing the sending of abusive messages, a hefty penalty of two years in prison or Kshs 300,000 fine has been introduced.Positive outcomes may include boosting the local arts industry and curtailing biased media reporting but the bill has also been described as limiting freedom of expression by the public and an attempt to ‘gag’ the media. With the Prime Minister’s apparent disapproval of the Act and media houses ability to publicise the same, quiet submission seems unlikely. Althea McCourt, ABIS Limited
